Legal Interpretations
Silverberg 1992
Summary
The Question
Does the FAA have prior policies or interpretations on the meaning of "schedule" in 14 CFR 121.481(a) and 14 CFR 121.483(a)?
Background
An attorney at Condon & Forsyth requested copies of FAA policies or interpretations on the term "schedule" in 14 CFR 121.481(a) and 14 CFR 121.483(a), concerning an infrequent situation where flight time calculated before flight exceeds the published schedule.
The FAA’s Interpretation
The FAA did not interpret the term; it retrieved 21 documents it believed were within the scope of the request, noted that files in the regional Assistant Chief Counsel offices were not included, and assessed $81.05 in processing costs under FOIA regulations.

Dear Mr. Silverberg:
This is in response to your letter dated December 27, 1991, and phone conversation of December 30, 1991, requesting copies of policies or interpretations involving Federal Aviation Regulations (FAR) §121.481(a) and 121.483(a). Specifically you are requesting those documents which involve the meaning of the term "schedule" as used within the stated FARs. From your phone conversation with one of our staff attorneys, Francis C. Heil, you state that your inquiry concerns an infrequent situation where the flight time calculated prior to flight is greater than that listed in the published flight schedule.
We have retrieved 21 documents, which we believe are within the scope of your request. These do not include any documents which may exist in the files of the offices of the Assistant Chief Counsels in the regions. Please note that although we have conducted an exhaustive review of our files of the relevant FAR sections, our files are such that there may be documents in other files not reasonably included in our search. We are confident, however, that the documents provided will meet your request. Under FOIA regulations, the costs involved in processing a request are recoverable by the Federal Aviation Administration (FAA) from the person submitting the request. The costs associated with your request are as follows:
65 photocopies @ 100/page =$ 6.50
Cost for search & review =$74.55 (5 hrs X 14.91 + 16%) $81.05 Total due Your check or postal money order should be made payable to the Treasury of the United States and sent to the following address:
U.S. Department of Transportation
Federal Aviation Administration Office
of Public Affairs, APA-220 800
Independence Avenue, S.W. Washington,
DC 20591
I trust this satisfactorily responds to your request.
Sincerely,
Donald P. Byrne
